All custom software development, mobile application engineering, website creation, and digital marketing retainers provided by Miniorbits are executed under formal, written Statements of Work (SOW) or Master Services Agreements (MSA) agreed to and executed by both parties. The specific deliverables, payment schedules, warranty periods, and milestones defined in that SOW shall govern the engagement.
3. Intellectual Property Rights
Upon complete settlement of agreed project milestone invoices, all custom source code, database architectures, design mockups, and creative marketing collateral authored specifically for the client under an approved SOW become the exclusive intellectual property of the client.
Miniorbits retains ownership of any pre-existing software frameworks, generic open-source libraries, developer toolchains, and internal workflow scripts utilized during development.
4. Honest Marketing & Performance Disclaimer
While Miniorbits adheres to rigorous, data-driven software engineering and digital marketing standards, we explicitly make no guarantees of specific search engine rankings (e.g., "Guaranteed #1 Google ranking"), predetermined revenue figures, or specific client acquisition volumes. Search engine algorithms and market dynamics fluctuate independently of agency control.
5. Limitation of Liability
In no event shall Miniorbits Private Limited, its directors, employees, or partners be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your access to or use of our website or digital materials.
